If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Refunds
We provide refunds for services sold on our Site as follows:
For any extras, upgrades or pre payments towards collections, a full refund will be given if the service does not go ahead on decision from the client. However the initial base session fee is not refundable under any circumstance.
Rescheduling and Cancellation
One complimentary reschedule is permitted with notice in excess of 72 hours. Less than 72 hours notice will forfeit your session fee, and a $200 rescheduling fee will apply.
Rescheduling for a SECOND TIME will forfeit your session fee, no matter the notice given, and a new session fee will need to be paid to secure a new date. For a complete cancellation at any time, the session fee is non-refundable.
Consumer Protection Law
Where federal consumer protection laws, including the Federal Trade Commission Act and the Magnuson-Moss Warranty Act, or any other applicable federal or state consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions shall be interpreted subject to the mandatory provisions of such laws. In the event of a conflict between these Terms and Conditions and the applicable legislation, the mandatory statutory provisions will prevail.
For residents of the State of Texas, these Terms and Conditions are subject to the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA). Nothing in these Terms and Conditions is intended to waive, limit, or exclude any rights or remedies available to you under the DTPA or any other mandatory Texas consumer protection statutes that cannot be lawfully waived by contract. To the extent any provision of these Terms and Conditions is found to be inconsistent with such mandatory Texas law, the relevant provisions of Texas law shall control.
Limitation of Liability
To the maximum extent permitted by applicable law, BBS and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; or (iii) unauthorized access, use, or alteration of your transmissions or content.
EXCEPT AS PROVIDED BY MANDATORY CONSUMER PROTECTION LAWS (INCLUDING THE TEXAS DTPA WHERE APPLICABLE), THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Tanya Rene Tarvin and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
You agree that any legal action or proceeding between you and Belle Boudoir Studio shall be brought exclusively in a court of competent jurisdiction sitting in Washington County, Texas. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection based on an inconvenient forum (forum non conveniens).
Severability
If any provision of these Terms and Conditions is held to be unenforceable, invalid, or illegal by a court of competent jurisdiction, the remaining provisions of these Terms and Conditions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, while maintaining the original intent of the parties. If such modification is not possible, the relevant provision shall be deemed severed from these Terms, and the validity and enforceability of the remaining provisions shall not be affected.
